Terms of Service
About These Terms
The website abrismtl.ca is operated by GROUPE ABRIS MTL INC., doing business as Abris MTL.
These terms govern the use of our website as well as the purchase of products and booking of services offered by Abris MTL.
By using our website, placing an order or booking a service, you agree to the terms applicable to the transaction and the policies associated with it.
These terms should be read together with our other policies, including our Shipping Policy, Return and Refund Policy, Service Booking Policy and Privacy Policy.
Use of the Website
You agree to use abrismtl.ca lawfully and not to use the website in a manner that may harm its operation, security, or the rights of Abris MTL or third parties.
In particular, you must not attempt to gain unauthorized access to the website, its systems or information not intended for you, introduce malicious code, or use the website for fraudulent or unlawful purposes.
Abris MTL may limit or suspend access to the website where there are reasonable grounds relating to security, fraud, misuse or compliance with the law.
Products and Services
Abris MTL offers car shelters and related services that may include installation, dismantling, delivery, on-site assessment and, when offered, rental.
The availability of products, dimensions, services and dates may vary according to inventory, season, geographic area and operational capacity.
Abris MTL may modify its offering, discontinue a product or service, or limit certain availability, subject to orders and commitments already accepted and rights provided by law.
Product Descriptions, Dimensions and Information
We make reasonable efforts to ensure that descriptions, specifications, dimensions, photographs and other information presented on abrismtl.ca are accurate.
Images are provided for representative purposes. The actual appearance of a product may vary slightly, including because of screen display, lighting or manufacturing variations that do not affect the essential characteristics of the product.
The customer must verify the selected model and dimensions before confirming an order. Where information is particularly important to the intended use of a product, we encourage you to contact Abris MTL before purchase.
Prices, Taxes and Errors
Prices displayed on abrismtl.ca are in Canadian dollars, unless otherwise indicated.
Applicable taxes and, where applicable, delivery fees or other applicable charges are presented during the ordering process.
Abris MTL may change its prices for future orders.
In the event of an obvious error concerning a price, description, availability or configuration, Abris MTL may correct the information. Where such an error affects an order already placed, we will contact the customer to determine an appropriate solution, subject to rights provided by law.
Orders and Confirmation
Receipt of an electronic order does not necessarily mean that it has been finally accepted or prepared.
Abris MTL may contact the customer to confirm information including the model, dimensions, delivery address, requested services and any information required to process the order.
We may refuse or cancel an order for a legitimate reason, including where a product is no longer available, a significant error is identified, payment cannot be validated, or there are reasonable grounds to suspect a fraudulent transaction.
Where a paid order must be cancelled by Abris MTL, any amounts to be refunded will be refunded in accordance with applicable laws and policies.
Information Provided by the Customer
The customer is responsible for providing accurate and sufficiently complete information to allow the order to be processed or the service to be performed.
This includes contact information, the delivery or service address, the selected dimensions or model, and relevant information regarding access to the site.
The customer must inform us as soon as possible if important information provided at the time of the order becomes inaccurate.
Delivery
Terms relating to service areas, delivery fees and delivery scheduling are set out in our Shipping Policy.
Dates or time windows shown before final confirmation may be estimates. Delivery is organized based on factors including availability, service area, route planning and conditions that allow transportation to be carried out reasonably and safely.
The customer must provide reasonable access to the delivery location and advise us in advance of any particular constraint that may affect delivery.
Installation, Dismantling and Other Services
Service appointments are organized based on team availability, service area, planned routes and site conditions.
Rules regarding cancellations, rescheduling, absences and appointment changes are set out in our Service Booking Policy.
Abris MTL may reschedule or stop a service where site conditions do not allow the service to be performed reasonably or safely.
Site Conditions and Customer Responsibilities
Before an installation or other service is performed on a property, the customer must ensure that Abris MTL has reasonable access to the work area and must advise us of any obstacle, hazard or particular condition known to the customer.
The customer remains responsible for checking the rules that apply to the property, including municipal by-laws, property rights, permissions from a landlord or condominium syndicate, or any other authorization that may be required.
An assessment or recommendation by Abris MTL regarding the location of a shelter does not constitute municipal or regulatory approval.
Shelter Care and Use
After delivery or installation, the customer is responsible for using and maintaining the shelter in accordance with the manufacturer's instructions and applicable conditions.
The customer is responsible in particular for monitoring weather conditions and performing reasonably necessary maintenance, including removal of snow accumulation where required.
The specific terms of any commercial warranty are indicated on the relevant product pages.
Rentals
When a car shelter rental is offered, it may be subject to specific terms communicated to the customer at the time of booking.
Those terms may address the rental period, reserved equipment, installation, dismantling, pickup, storage, cancellations and responsibilities relating to the rented equipment.
If there is any difference between these general terms and specific rental terms accepted by the customer, the specific rental terms prevail for the matters they govern, subject to the law.
Returns, Cancellations and Refunds
Terms applicable to product returns, sizing errors, changes of mind, damaged or incorrect products, and refunds are set out in our Return and Refund Policy.
Cancellations and rescheduling relating to service appointments are governed by our Service Booking Policy.
Nothing in these terms limits any cancellation rights or other remedies that a consumer may have under laws applicable to distance contracts. Office de la protection du consommateur
Warranties
Products sold or rented by Abris MTL benefit from the legal warranties applicable in Quebec.
These warranties apply independently of any commercial warranty offered by Abris MTL or the manufacturer and include protections relating to normal use of the product, reasonable durability, latent defects and conformity with representations made about the product. Office de la protection du consommateur
Where a manufacturer's commercial warranty applies, its terms, duration and exclusions are indicated on the relevant product pages or in the applicable documentation.
These terms do not exclude or limit any legal warranty that cannot be excluded by contract.
Weather Conditions and Circumstances Beyond Our Control
Certain Abris MTL activities depend on weather conditions, road conditions, site access, product availability and other operational circumstances.
Where circumstances reasonably beyond our control prevent or delay a delivery or service, Abris MTL may need to change the scheduled date or propose another solution.
This provision does not limit the customer's rights to a refund, cancellation or any other remedy where those rights are provided by law.
Intellectual Property
Unless otherwise indicated, the text, photographs, graphics, logos, layouts and other content on abrismtl.ca belong to Abris MTL or are used with the authorization of their respective owners.
No part of the website may be reproduced, distributed, commercially exploited or used in a manner that infringes applicable rights without authorization, except where permitted by law.

Website Availability
Abris MTL seeks to keep abrismtl.ca accessible and functional, but cannot guarantee that the website will be available without interruption or free from technical errors.
We may perform maintenance, updates or technical changes where necessary.
To the extent permitted by law, Abris MTL is not responsible for temporary website interruptions that are unrelated to an order or contractual obligation already accepted.
Liability
Abris MTL is responsible for its obligations in accordance with applicable law.
To the extent permitted by law, Abris MTL is not liable for damage resulting from use of the website or a product contrary to provided instructions, inadequate maintenance, an unauthorized modification of a product, or a situation attributable to the customer or a third party.
Nothing in these terms excludes or limits any liability, warranty or remedy that cannot legally be excluded or limited.
Governing Law
These terms are governed by the laws applicable in the province of Quebec and the federal laws of Canada applicable there.
Where the transaction is a consumer contract, mandatory consumer-protection provisions continue to apply.
For distance contracts, the contract is deemed to be entered into at the consumer's address in accordance with the rules applicable in Quebec. Office de la protection du consommateur
Changes to These Terms
Abris MTL may update these terms to reflect changes to its offering, practices or legal requirements.
The version published on abrismtl.ca is the version then in effect for future use of the website.
A later change to these terms does not retroactively change the rights or obligations applicable to a transaction already completed, except where permitted by law or by agreement with the customer.
Severability and No Waiver
If any provision of these terms is declared invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Abris MTL's failure to exercise a right immediately does not constitute a waiver of that right.
